Service Description

Nebraska Pest Control provides residential and commercial pest management services throughout the state of Nebraska. Our services include inspection, identification, treatment, and ongoing monitoring for common pests including but not limited to ants, termites, rodents, spiders, cockroaches, bed bugs, wasps, and other insects and wildlife that may infest properties. Treatment methods may include chemical applications, baiting systems, trapping, exclusion techniques, and integrated pest management approaches. Specific services, treatment frequencies, and coverage areas will be detailed in your individual service agreement or work order. We reserve the right to modify our service offerings, treatment methodologies, and product formulations based on seasonal conditions, regulatory requirements, pest behavior patterns, and technological advancements. All services are performed by licensed technicians in accordance with Nebraska Department of Agriculture regulations and applicable federal guidelines.

No Guarantee or Warranty

Nebraska Pest Control makes no express or implied guarantees regarding the complete elimination of pests from your property. Pest control results depend on numerous factors outside our reasonable control, including but not limited to: neighboring property conditions, structural integrity of buildings, environmental conditions, weather patterns, pest reproductive cycles, and customer cooperation with preparation and follow-up instructions. While we employ trained professionals and proven methods, pest behavior is inherently unpredictable. No warranty is provided that treated areas will remain pest-free for any specific duration. Our service warranties, if any, are limited to retreatment of specified areas within defined timeframes and do not cover damage caused by pests, consequential damages, or new infestations from external sources. Any limited warranty provided shall be strictly construed according to its specific terms and conditions.

User Responsibilities

You agree to provide accurate information regarding property conditions, pest history, and any known hazards prior to service. You must ensure safe access to all areas requiring treatment and secure pets, children, and sensitive individuals during and immediately following applications as directed. You are responsible for following all pre-treatment and post-treatment instructions provided by our technicians, including but not limited to: removing food items, covering fish tanks, vacating premises for specified periods, avoiding treated areas until dry, maintaining sanitation standards, and eliminating conducive conditions such as standing water, food debris, and structural entry points. Failure to comply with these responsibilities may diminish treatment effectiveness and void any retreatment obligations. You must notify us immediately of any adverse reactions, property damage concerns, or persistent pest activity. You represent that you have legal authority to authorize pest control services for the subject property.

Limitation of Liability

To the maximum extent permitted by Nebraska law, Nebraska Pest Control's total liability arising from or relating to our services shall not exceed the total amount actually paid by you for the specific service giving rise to the claim. We shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to: property damage, loss of use, loss of profits, personal injury beyond direct physical harm caused by our negligence, emotional distress, or costs of alternative accommodations or services, regardless of whether such damages were foreseeable or whether we were advised of the possibility. This limitation applies to all claims, whether based on contract, tort, strict liability, negligence, or any other legal theory. You acknowledge that pest control services inherently involve certain risks and that our pricing reflects this allocation of risk.

Intellectual Property

All content on our website, marketing materials, service documentation, treatment protocols, and proprietary methodologies are the exclusive property of Nebraska Pest Control and are protected by United States copyright, trademark, and trade secret laws. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any of our materials without prior written consent. Our business name, logos, slogans, and service marks are registered or unregistered trademarks owned by Nebraska Pest Control. Any unauthorized use constitutes infringement and may result in legal action. Feedback or suggestions you provide regarding our services may be used without compensation or attribution. You retain ownership of your personal information subject to our Privacy Policy.

Governing Law

These Terms of Service and any disputes arising from or relating to our services shall be governed by and construed in accordance with the laws of the State of Nebraska, without regard to conflict of law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Lancaster County, Nebraska. You consent to the personal jurisdiction and venue of such courts and waive any objection to jurisdiction or venue based on inconvenience or otherwise. The provisions of these terms are severable, and if any provision is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. These terms constitute the entire agreement between you and Nebraska Pest Control regarding the subject matter herein and supersede all prior agreements, representations, and understandings.

Changes become effective immediately upon posting to our website with an updated effective date. Your continued use of our services following any changes constitutes acceptance of the revised terms. We encourage you to review these terms periodically. Material changes affecting your rights or obligations may be communicated through additional means at our discretion, but we are not obligated to provide individual notification of all modifications. The version of these terms in effect at the time services are rendered shall govern those specific services. If you do not agree to any modified terms, you must discontinue using our services and notify us to terminate any ongoing service agreement in accordance with its cancellation provisions.
